Terms and Conditions

The following terms and conditions apply to your enrolment on the Janssen-Cilag Pty Ltd (Janssen) patient support platform (Platform) and to the following patient support programs and service offerings: [insert relevant Janssen PSPs] (together the Programs, each a Program).

Participation in a Program is open to patients who have been prescribed one of [INSERT RELEVANT MEDICATION(S)(together the Medications, each a Medication).  Janssen reserves the right to exclude participants who are not eligible to use a Program.

The Programs are sponsored by Janssen and administered by third party service providers (as set out below), and any third-party service provider Janssen may engage in their place from time to time (together the Program Managers, each a Program Manager):

The services provided under each Program may vary depending on:

  • the Program information provided; and
  • your needs, depending on the Medication.

By accepting these terms and conditions you accept their application to your enrolment onto the Platform and to each Program.  You also consent to being registered for the Program relevant to the Medication you are being treated with.

  1. All communications with You as part of any Program will be provided by the relevant Program Manager, a registered nurse provided by the relevant Program Manager (the Support Nurse) or Janssen.
  2. You hereby consent to the Support Nurse:
    1. contacting You to remind you to arrange appointment times for treatment and provide appointment reminders;
    2. obtaining your Medication treatment chart from your healthcare professional who prescribes your Medication (your HCP);
    3. contacting You or your HCP if further details are required regarding your prescription, and providing these details to other Program nurses for the purpose of administering a Program for You;
    4. attending You at an agreed location to provide Medication administration education and support.
  3. Subject to paragraph 8 below, enrolment in a Program will continue for as long as You are being treated with the relevant Medications (the Term) and will terminate on the earlier of the date that:
    1. You cease to be treated with the relevant Medications; or
    2. You opt out of the relevant Program.
  4. You must notify the relevant Program Manager if You cease to be prescribed a relevant Medication during the Term.
  5. You agree to notify Janssen if the HCP prescribing your Medication changes.
  6. You acknowledge that Your HCP may withdraw You from a Program if they think the Program will no longer be beneficial for You or if they no longer prescribe any of the relevant Medications to You, or for any other valid reason.
  7. You acknowledge and agree that each Program Manager is legally obliged to pass on details of any adverse event, special situation or product quality complaint that they become aware of, to Janssen.  You understand that Janssen or an authorised third party may contact Your HCP for the purpose of an adverse event, special situation or product quality complaint follow up.
  8. Janssen reserves the right to cease funding any or all of the Programs (or any part of a Program) and to terminate or vary any Program or any part of a Program at any time. The relevant Program Manager will use reasonable endeavors to contact You to notify You of the cessation or variation.
  9. Information received from any Program Manager, any Support Nurse or Janssen must not be relied on or interpreted as medical or other advice in relation to Your condition or the Medications.
  10. Any information, advice or directions received from any Support Nurse is general in nature and does not replace any information, advice or directions that Your treating healthcare professional (including your HCP) provides.  You should always discuss any concerns or questions you may have regarding Your health or the relevant Medication with your HCP.
  11. The cost of each Program is funded by Janssen, and neither Your HCP nor any healthcare professional engaged in the management of Your health is provided with payment of any kind for using any Program or suggesting that You enrol in a Program.
  12. You understand that from time to time, the relevant Program Manager and/ or Janssen may contact you to get feedback about your experience of a Program. This is to help improve the relevant Program and increase the satisfaction of the participants.
  13. You have read and understand and agree with the terms of the Patient Privacy Statement set out below.
  14. You have read and understand and agree with the terms of the Janssen Privacy Policy set out below.
  15. You may opt out of any part of a Program (e.g. telephone, mail and/or other communications) or the whole Program or Programs at any time by contacting the relevant Program Manager at the details set out below:
  1. If you have any questions, complaints or claims in relation to any Program you should contact the relevant Program Manager on the details provided above.
  2. These Terms and Conditions are governed by the laws in New South Wales and if any of these Terms and Conditions is invalid, unenforceable or illegal, that term will be struck out and the remaining terms will remain in full force.
